These Terms & Conditions govern all creative, production, photography, videography, advertising, branded content, and post-production services provided by Atelier World Productions to any client (“Client”).
By confirming a project, approving a proposal, issuing a purchase order, or making an advance payment, the Client agrees to these Terms & Conditions.
Atelier World Productions provides services including but not limited to:
Advertising films & branded content
Film & video production
Music videos
Photography & photoshoots
Editing, color grading, VFX & post-production
Digital & social media content
The exact scope, deliverables, timelines, and costs shall be as defined in the approved proposal, quotation, email confirmation, or agreement.
50% advance payment is required to confirm the project and initiate pre-production.
The remaining 50% payment is due at the time of final delivery of the completed project.
No raw footage, final deliverables, source files, or usage rights will be released until full payment is received.
All payments made are non-refundable, unless otherwise expressly agreed in writing.
Delayed payments may result in suspension of delivery or additional charges.
The Company reserves the right to pause or terminate services in case of non-payment.
Project timelines depend on timely client approvals, feedback, payments, and asset sharing.
Delays caused by the Client may result in revised schedules and additional costs.
The Company shall not be held responsible for delays due to weather conditions, location permissions, talent availability, technical issues, or third-party dependencies.
Revisions included shall be limited to those mentioned in the approved proposal.
Additional revisions or changes beyond the agreed scope will be charged extra.
Any major creative change after approval may be treated as a new scope of work.
Upon receipt of full payment, the Client is granted rights to use the final approved deliverables for the agreed platforms, geography, duration, and purpose.
Any usage beyond the agreed scope may require additional licensing or fees.
Atelier World Productions retains the perpetual right to use all videos, films, photographs, frames, or creatives produced for any client for:
Portfolio & showreels
Website & social media
Pitch decks & presentations
Awards, festivals & industry references
This usage is strictly for self-promotional and reference purposes and does not imply ownership of the Client’s brand or trademarks.
Portfolio usage restrictions, if any, must be agreed in writing before project commencement.
The Company may include its name or credit where appropriate unless otherwise agreed in writing.
Removal of credits without prior consent is not permitted.
Raw footage, project files, or source assets are not included unless explicitly mentioned in the agreement.
If agreed, raw footage delivery will be charged separately.
The Company is not responsible for archiving or storing project files beyond 30 days after final delivery, unless agreed otherwise.
Talent, music, stock footage, and location licenses are limited to the agreed usage terms.
Any extension of usage may require additional payments to third parties.
The Company is not responsible for unauthorized or extended usage by the Client.
The Client confirms that they hold all necessary rights, licenses, and permissions for any materials, logos, scripts, references, or brand assets provided.
The Client agrees to indemnify and hold the Company harmless against any claims arising from the use of such materials.
In case of cancellation after advance payment, the advance amount shall be retained to cover pre-production, planning, and resource allocation costs.
Postponements may attract additional charges based on crew, equipment, and scheduling commitments.
Creative work is subjective in nature.
The Company retains creative discretion while executing the approved brief.
Minor artistic variations shall not be considered defects or grounds for rejection.
The Company shall not be liable for delays or failure to perform due to events beyond reasonable control, including but not limited to natural disasters, pandemics, government restrictions, strikes, technical failures, or acts of God.
The Company’s total liability shall not exceed the total project value.
The Company shall not be liable for any indirect, incidental, or consequential losses, including loss of business, revenue, or marketing performance.
Any confidential information shared by the Client shall be kept confidential unless required by law or with written consent.
These Terms & Conditions shall be governed by the laws of India.
Any disputes shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra.
Confirmation of a project, advance payment, or commencement of work shall constitute full acceptance of these Terms & Conditions.
